Art. 1.
Fica aprovada a programação financeira e o cronograma de execução mensal de desembolso para o exercício financeiro de 2005, na forma do Anexo I, parte integrante deste Decreto.
§ 1ºOs valores constantes do Anexo I, constituídos pela Receita Líquida Disponível (Fontes “0100”, “0130”, “1100”, “2100”, “3100”), estarão à disposição por meio do Sistema de Acompanhamento da Execução Orçamentária e Financeira e, quando utilizados, serão contabilizados como Cotas de Despesas Concedidas aos Órgãos e Entidades do Poder Executivo.
§ 2ºAs cotas mensais pertencentes aos Poderes Legislativo e Judiciário, ao Tribunal de Contas do Estado, ao Ministério Público e à Fundação Universidade do Estado de Santa Catarina serão repassadas de acordo com o disposto na Constituição Estadual e na Lei de Diretrizes Orçamentária.
§ 3ºOs valores estabelecidos para as despesas de custeio, investimentos e demais despesas correntes e de capital dos órgãos e entidades do Poder Executivo à conta dos recursos das fontes “0100”, “0130”, “1100”, “2100”, “3100” sofrerão contingenciamento médio de 41,77% (quarenta e um inteiros e setenta e sete centésimos por cento), a título de valores a programar, factíveis de liberação durante o exercício financeiro em decorrência do efetivo comportamento da receita.
§ 4ºObservado o disposto no Decreto nº 231, de 14 de maio de 2003, os investimentos relativos à execução de obras e instalações, à aquisição de equipamentos e material permanente e a auxílios para despesas de capital, a serem realizados durante o exercício financeiro, estão condicionados à autorização do Governador do Estado em exposição de motivos a ele submetida pelo titular do órgão interessado.

Aprova a programação financeira e o cronograma de execução mensal de desembolso para o exercício financeiro de 2005, em atendimento ao que estabelece o art. 8º da Lei Complementar Federal nº 101, de 04 de maio de 2000, e dá outras providências.

O GOVERNADOR DO ESTADO DE SANTA CATARINA, usando da competência privativa que lhe confere o art. 71, incisos I e III, da Constituição do Estado e tendo em vista o disposto no art. 8º da Lei Complementar Federal nº 101, de 4 de maio de 2000, e no art. 13 da Lei nº 13.095, de 09 de agosto de 2004,

D E C R E T A:

Art. 2.
Os recursos legalmente vinculados à finalidade específica deverão ser programados pelo órgão ou entidade a que pertencerem, segundo a perspectiva de ingresso, e serão utilizados exclusivamente para atender ao objeto de sua vinculação, ainda que em exercício diverso daquele em que ocorrer o ingresso, ressalvada a possibilidade de aplicação do disposto no art. 10 da Lei nº 17.565, de 25 de janeiro de 2005.
Art. 3.
Cabe à Diretoria do Tesouro Estadual da Secretaria de Estado da Fazenda, com base nos valores constantes do Anexo I e considerando a evolução da receita, proceder mensalmente à liberação dos recursos financeiros aos órgãos e entidades.
Art. 4.
O valor total das notas de empenho emitidas mensalmente não poderá exceder ao valor da liberação financeira programada para o respectivo mês, de acordo com o Anexo I.
§ 1ºExcluem-se da proibição as notas de empenho decorrentes de convênios, contratos e ajustes que resultem em comprometimento orçamentário a título de Despesa Orçamentária a Liquidar.
§ 2ºCaso o montante das notas de empenho emitidas não alcance a limitação de que trata este artigo, poderá o órgão ou entidade utilizar a diferença no mês subseqüente ao vencido, mediante autorização expressa da Secretaria de Estado da Fazenda.
Art. 5.
O aumento do capital das sociedades de economia mista fica limitado aos recursos de caixa do Tesouro do Estado e só será realizado se os correspondentes créditos orçamentários estiverem previstos.
Parágrafo únicoO aumento do capital previsto no caput fica condicionado, também, à apresentação da ata da Assembléia Geral que o autorizou e do ato de homologação do Conselho de Política Financeira – CPF.
Art. 6.
Para as despesas com prestação de serviços por pessoas jurídicas, compreendendo tarifas de energia elétrica, água e esgoto, serviços de comunicação (telefone, fax e correio), serviços de informática, locação de imóveis, locação de equipamentos e material permanente, conservação e adaptação de bens imóveis, serviços de asseio e higiene, serviços de divulgação, impressão e encadernação, passagens e despesas com locomoção, serão obrigatórias as emissões de notas de empenho pelo valor global.
Art. 7.
Toda e qualquer transferência de recursos de entes da federação ou de entidades privadas a título de auxílio, convênio ou ajuste de qualquer natureza deverá ser preliminarmente contabilizada pela Secretaria de Estado da Fazenda.
Art. 8.
Fica a Secretaria de Estado da Fazenda autorizada a realizar provisão financeira mensal para o pagamento de gratificação natalina até o equivalente a 8,33% (oito inteiros e trinta e três centésimos por cento) do total da folha de pessoal.
Art. 9.
Os recursos financeiros de que trata este Decreto não serão disponibilizados aos órgãos e entidades que não se encontrarem em dia com os prazos de entrega de balancetes e balanços contábeis ou que não tenham cumprido as determinações de auditoria ditadas pela Diretoria de Auditoria Geral, de que trata o Decreto nº 425, de 5 de agosto de 1999.
Parágrafo únicoCaberá à Diretoria de Contabilidade Geral informar à Diretoria do Tesouro Estadual acerca da regularidade dos prazos de entrega dos balancetes e balanços e à Diretoria de Auditoria Geral no que tange ao disposto no Decreto referido no caput.
Art. 10.
É vedado à Secretaria de Estado da Fazenda repassar recursos, a qualquer título, às sociedades de economia mista que não mantenham em dia seus compromissos com COFINS, FGTS, PIS e Previdência Social.
Parágrafo únicoSomente serão realizados repasses às entidades mencionadas no caput que comprovarem junto à Diretoria do Tesouro Estadual o pagamento dos mencionados encargos.
Art. 11.
Caberá à Diretoria do Tesouro Estadual, a qualquer tempo e considerando o estado das finanças públicas, propor a revisão do cronograma a que se refere este Decreto, evidenciando os valores programados e os realizados e procedendo à sua divulgação no Diário Oficial do Estado e no “site” da Secretaria de Estado da Fazenda”.
Art. 12.
Este Decreto entra em vigor na data de sua publicação.
Art. 13.
Revogam-se as disposições em contrário.
