Art. 1.

Fica aprovada a programação financeira e o cronograma de execução mensal de desembolso de recursos estaduais para o exercício financeiro de 2009, na forma do Anexo único deste Decreto.

§ 1ºAs quotas orçamentárias, programadas conforme o Anexo único serão colocadas à disposição por meio do Sistema de Acompanhamento da Execução Orçamentária e Financeira e os recursos do Tesouro, quando utilizados, serão contabilizados como Cotas de Despesas Concedidas aos Órgãos e Entidades do Poder Executivo.

§ 2ºOs valores orçamentários referentes às fontes relacionadas a convênios com o Governo Federal serão reprogramados na medida em que os recursos forem creditados nas contas bancárias respectivas dos convênios.

§ 3ºAs quotas mensais pertencentes aos Poderes Legislativo e Judiciário, ao Tribunal de Contas do Estado, ao Ministério Público e à Fundação Universidade do Estado de Santa Catarina serão repassadas de acordo com o disposto na Constituição Estadual e na Lei de Diretrizes Orçamentárias.

§ 4ºOs valores estabelecidos para as despesas de custeio, investimentos e demais despesas correntes e de capital dos órgãos e entidades do Poder Executivo, em todas as fontes, sofrerão contingenciamento médio de 38,2% (trinta e oito inteiros e dois décimos por cento), a título de valores a programar, factíveis de liberação durante o exercício financeiro, de acordo com o comportamento da receita.

§ 5ºAs revisões da programação que impliquem no aumento do percentual de contingenciamento previsto no parágrafo anterior deverão ser publicadas em Decreto, no qual serão estabelecidas as novas projeções mensais e bimestrais da receita por fonte de recursos e os valores das despesas reprogramados para cada um dos meses do exercício financeiro.

§ 6ºOs créditos descentralizados na forma prevista na Lei nº 12.931, de 13 de fevereiro de 2004, serão abatidos na quota prevista para o órgão ou entidade descentralizador no cronograma de execução mensal de desembolso.

Aprova a programação financeira e o cronograma de execução mensal de desembolso para o exercício financeiro de 2009, em consonância com os arts. 8º e 9º da Lei Complementar Federal nº 101, de 4 de maio de 2000, e estabelece outras providências.

O GOVERNADOR DO ESTADO DE SANTA CATARINA, no uso da competência privativa que lhe confere o art. 71, incisos I e III, da Constituição do Estado e tendo em vista o disposto nos arts. 8º e 9ºda Lei Complementar Federal nº 101, de 4 de maio de 2000,

Art. 2.

Cabe à Diretoria do Tesouro Estadual da Secretaria de Estado da Fazenda, com base nos valores constantes no Anexo único e considerando a evolução da receita, proceder mensalmente à liberação dos recursos financeiros aos órgãos e entidades.

Art. 3.

As contratações de fornecimento de bens e serviços e a execução orçamentária da despesa deverão estar em estrita consonância com os limites estabelecidos nas quotas financeiras de cada órgão, de acordo com o Anexo único.

Art. 4.

O aumento do capital das sociedades de economia mista fica limitado aos recursos de caixa do Tesouro do Estado e só será realizado se os correspondentes créditos orçamentários estiverem previstos.

Parágrafo únicoO aumento do capital previsto no caput fica condicionado, também, à apresentação da ata da Assembléia Geral que o autorizou e do ato de homologação do Conselho de Política Financeira - CPF.

Art. 5.

Para as despesas de caráter continuado será obrigatório o empenho por estimativa anual, e para as despesas relativas a convênios e contratos de licitação serão obrigatórias as emissões de notas de empenho pelo valor global.

Parágrafo únicoO empenho das despesas de que trata o caput deste artigo, bem como o empenho de todas as demais despesas estaduais, terá como limite as disponibilidades financeiras previstas na programação financeira e no cronograma mensal de desembolso de que trata o presente Decreto.

Art. 6.

Fica a Secretaria de Estado da Fazenda autorizada a realizar provisão financeira mensal para o pagamento de gratificação natalina até o equivalente a 8,33% (oito inteiros e trinta e três centésimos por cento) do total da folha de pessoal.

Art. 7.

Os recursos financeiros de que trata este Decreto não serão disponibilizados aos órgãos e entidades que não estiverem em dia com os prazos de entrega de balancetes e balanços contábeis.

Art. 8.

É vedado à Secretaria de Estado da Fazenda repassar recursos, a qualquer título, às sociedades de economia mista que não mantenham em dia seus compromissos com COFINS,FGTS,PIS e Previdência Social.

Parágrafo únicoSomente serão realizados repasses às entidades mencionadas no caput que comprovarem junto à Diretoria do Tesouro Estadual o pagamento dos mencionados encargos.

Art. 9.

O Órgão Central do Sistema de Planejamento e Orçamento poderá modificar, sem a necessidade de ato de alteração orçamentária, mantidas as normas constitucionais e legais, através do Sistema Integrado de Planejamento e Gestão Fiscal - SIGEF, as categorias econômicas, os grupos de natureza de despesa, o elemento de despesa dentro do mesmo projeto ou atividade, bem como a modalidade de aplicação e o identificador de uso - iduso das destinações de recursos.

Art. 10.
Este Decreto entra em vigor na data de sua publicação.
