Institui o Programa Internacional “Visão Global do Poder Judiciário”.

O PRESIDENTE DO CONSELHO NACIONAL DE JUSTIÇA (CNJ), no uso de suas atribuições legais e regimentais,

CONSIDERANDO a necessidade de estimular os tribunais brasileiros na busca pela excelência, o que se traduz especialmente na disseminação de informações e de boas práticas no incremento da eficiência da prestação jurisdicional;

CONSIDERANDO a importância das cooperações internacionais como estímulo à troca de informações e ao debate jurídico, de maneira a coordenar esforços para o alcance de objetivos comuns;

CONSIDERANDO que a integração entre os atores do Poder Judiciário é de fundamental importância para o fortalecimento e promoção da segurança jurídica, como fator de estabilidade política, econômica e social;

CONSIDERANDO o deliberado pelo Plenário do CNJ no procedimento Ato no 0006174-20.2021.2.00.0000, na 336ª Sessão Ordinária, realizada em 17 de agosto de 2021;

RESOLVE:

CAPÍTULO I

DAS DISPOSIÇÕES INICIAIS

Art. 1.
Instituir o Programa Internacional “Visão Global do Poder Judiciário”, em caráter nacional, permanente e de fluxo contínuo, que passa a ser regulamentado por esta Resolução.
Art. 2.
O Programa Internacional “Visão Global do Poder Judiciário” destina-se exclusivamente a magistrados estrangeiros de todas as nações com as quais o Brasil mantenha relações diplomáticas que possuam interesse em conhecer os órgãos do Poder Judiciário brasileiro pelo período mínimo de 1 (um) mês. § 1ºO magistrado estrangeiro não poderá exercer a jurisdição no território brasileiro.
§ 2ºAs atividades desenvolvidas no âmbito do programa têm caráter de serviço voluntário, nos termos da Lei no 9.608/1998, não gerando vínculo empregatício, nem obrigação de natureza trabalhista previdenciária ou afim.
§ 3ºTodas as despesas pessoais, de estadia, de deslocamento e de alimentação serão custeadas pelos próprios magistrados ou pelo seu tribunal de origem.

CAPÍTULO II

DOS OBJETIVOS

Art. 3.
São objetivos do Programa Internacional “Visão Global do Poder Judiciário”:
Ipropiciar o conhecimento mútuo das atividades dos tribunais, com enfoque no compartilhamento de boas práticas e soluções inovadoras nas áreas administrativas e judiciárias;
IIestimular o conhecimento da realidade jurídica de outros países;
IIIapoiar o desenvolvimento de linhas de cooperação no campo da gestão e da atividade judiciária;
IVestabelecer e fortalecer laços de amizade e parcerias com organismos e instituições do Sistema de Justiça mundial;
Vdar visibilidade às práticas de sucesso que contribuem para a eficiência do Poder Judiciário brasileiro, e
VIproporcionar a troca de experiências e informações entre os órgãos do Sistema de Justiça brasileiro e internacionais, promovendo o aperfeiçoamento, a modernização e a eficiência do Judiciário.
Parágrafo únicoO alcance dos objetivos indicados nos incisos deste artigo observará as diretrizes de gestão estabelecidas pelo órgão anfitrião, que corresponde a cada tribunal ou órgão do Poder Judiciário em que as atividades serão realizadas.

CAPÍTULO III

DAS INSCRIÇÕES

Art. 4.
Para se candidatar ao Programa Internacional “Visão Global do Poder Judiciário”, o magistrado estrangeiro deverá realizar inscrição no CNJ, por meio de formulário eletrônico, de acordo com as instruções divulgadas em língua portuguesa e em, no mínimo, uma língua estrangeira, preferencialmente no inglês.
Art. 5.
Para receber o magistrado estrangeiro no programa será exigido:
Icópia do documento obrigatório para entrada no país, acompanhada do respectivo original;
IIcurriculum vitae, em português, com foto e descrição da(s) área(s) que deseja conhecer no órgão anfitrião;
IIIdocumento que comprove a condição de magistrado há pelo menos 3 (três) anos ou, ainda, que se trata de magistrado aposentado há menos de 3 (três) anos; (redação dada pela Resolução n. 445, de 14.3.2022)
IVcarta de referência do tribunal de origem;
Vcomprovante do pagamento do seguro-saúde obrigatório para todo o período do programa;
VIassinatura de Termo de Compromisso com o órgão anfitrião, nos termos do Anexo desta Resolução;
VIIconhecimento da língua portuguesa, que poderá ser afirmado por meio de autodeclaração e demonstrado em eventual entrevista; (redação dada pela Resolução n. 445, de 14.3.2022)
VIIIcertidão de nada consta criminal ou documento afim que comprove a não condenação ou punição na esfera disciplinar nos últimos 3 (três) anos.
Art. 6.
O magistrado deverá indicar, no formulário de inscrição, o órgão do Poder Judiciário em que deseja realizar o programa.
§ 1ºO CNJ contatará o tribunal indicado para verificar o interesse em participar do programa e receber o(s) magistrado(s) habilitado(s).
§ 2ºApós a aceitação formal do órgão anfitrião, o candidato deverá apresentar prova de liberação do órgão de origem.
Art. 7.
É autorizada a indicação de mais de um órgão do Poder Judiciário, desde que as inscrições sejam realizadas em formulários distintos e de forma separada.
Parágrafo únicoHavendo aceitação de mais de um tribunal, o magistrado poderá optar por ter a experiência em mais de um órgão, desde que o período de atividades em cada um não seja simultâneo, não seja inferior a 2 (dois) meses e que os órgãos anfitriões aceitem a situação.
Art. 8.
A confirmação da inscrição será enviada para o endereço eletrônico indicado no formulário de inscrição.
Art. 9.
Ao ser efetivada a inscrição, todas as normas desta Resolução estarão automaticamente aceitas pelo candidato.
Art. 10.
não preenchimento dos requisitos estabelecidos neste regulamento ensejará o indeferimento da inscrição.

CAPÍTULO IV

DA SUPERVISÃO

Art. 11.
As atividades do magistrado estrangeiro serão acompanhadas pela unidade de assuntos internacionais do órgão anfitrião, ou unidade congênere, com o suporte da unidade de gestão de pessoas.
Parágrafo únicoA Presidência do órgão anfitrião deverá designar um magistrado supervisor, a quem incumbe:
Ireceber o magistrado e orientá-lo sobre aspectos de conduta e normas do órgão; e
IIorganizar atividades direcionadas à interação do magistrado com o Poder Judiciário brasileiro, tais como: o acompanhamento de audiências e de sessões de julgamento, a exposição sobre o funcionamento da justiça nacional, o acompanhamento da rotina de trabalho de juízes de primeira e segunda instâncias, entre outras.
Art. 12.
expediente dos magistrados participantes do programa obedecerá às normas que disciplinam o funcionamento do órgão anfitrião.
Parágrafo únicoAs faltas e os atrasos poderão ser compensados a critério do supervisor.

CAPÍTULO V

DOS DIREITOS

Art. 13.
São direitos do participante do Programa Internacional “Visão Global do Poder Judiciário”:
Iindicar unidades de interesse no âmbito do órgão anfitrião;
IIreceber documento de identificação, de uso obrigatório, para acesso ao órgão anfitrião;
IIIreceber orientação para o desempenho das atividades que lhe forem atribuídas e ser acompanhado por supervisor, o qual verificará sua frequência; e
IVobter, ao final do programa, certificado de participação emitido pela Presidência do órgão anfitrião, observadas as exigências previstas nos incisos I e II do art. 14.

CAPÍTULO VI

DOS DEVERES

Art. 14.
São deveres do participante do Programa Internacional “Visão Global do Poder Judiciário”:
Iobservar as normas do órgão anfitrião;
IIcumprir, no mínimo, 75% (setenta e cinco por cento) da programação do programa e realizar as atividades que lhe forem atribuídas;
IIIem caso de desistência, comunicar à unidade em que estiver atuando e ao supervisor;
IVzelar pelos bens patrimoniais do órgão anfitrião; e
Vdevolver o documento de identificação, por ocasião de seu desligamento.
§ 1ºO magistrado estrangeiro deverá apresentar à unidade de assuntos internacionais ou órgão congênere do anfitrião relatório de suas atividades após a conclusão do programa.
§ 2ºEventual produção acadêmica-científica decorrente do programa deverá fazer menção expressa ao Programa Internacional “Visão Global do Poder Judiciário”.
§ 3ºAplicam-se ao magistrado estrangeiro, no que couber, os deveres e as proibições previstas na Lei Complementar no 35/1979 e na Lei no 8.112/1990.

CAPÍTULO VII

DO DESLIGAMENTO

Art. 15.
desligamento do participante ocorrerá:
Iao término do prazo de validade do programa;
IIpor interesse e conveniência do órgão anfitrião ou do tribunal de origem;
IIIa pedido do magistrado estrangeiro;
IVpor abandono, caracterizado pela ausência não justificada durante 2 (dois) dias consecutivos ou 3 (três) intercalados, no período do programa;
Vpor descumprimento, pelo magistrado, de qualquer cláusula do Termo de Compromisso; e
VIpor conduta incompatível com a exigida pelo órgão anfitrião.
Parágrafo únicoO órgão anfitrião comunicará ao tribunal de origem os casos de desligamento ocorridos.

CAPÍTULO VIII

DAS DISPOSIÇÕES FINAIS

Art. 16.
Sem prejuízo das regras previstas na presente Resolução, a Presidência do CNJ poderá dirimir dúvidas e suprir lacunas sobre a sua aplicação, bem como editar portarias e editais estabelecendo novos prazos, condições e requisitos para a participação no Programa Internacional “Visão Global do Poder Judiciário”, que serão disponibilizados em português e em, no mínimo, uma língua estrangeira, preferencialmente no inglês.
Art. 17.
Esta Resolução entra em vigor na data de sua publicação.

THE PRESIDENT OF THE NATIONAL COUNCIL OF JUSTICE (CNJ), in the use of his legal and regimental attributions,

CONSIDERING the need to encourage Brazilian courts in pursuit of excellence, especially by disseminating information and good practices that increase jurisdictional efficiency;

CONSIDERING that international cooperation encourages the exchange of information and legal debate in order to coordinate efforts and achieve common goals;

CONSIDERING that integration among members of the Judiciaries strengthens and promotes legal certainty as well as political, economic, and social stability;

CONSIDERING CNJ Plenary's decision in the case n. 0006174- 20.2021.2.00.0000, at the 336th Ordinary Session, held on August 17th, 2021,

RESOLVES:

CHAPTER I

INITIAL PROVISIONS

Article 1

Establishes the International Program "Global Vision of the Judiciary", on a national, permanent, and continuous flow basis, in accordance with the rules set forth in the present Resolution.

Article 2

The International Program “Global Vision of the Judiciary” is exclusively intended for foreign judges from all the nations with which Brazil maintain diplomatic relations that have an interest in getting to know the bodies of the Brazilian Judiciary Power for a minimum period of 1 (one) month. (ammendment made by Resolution n°. 445, of 3.14.2022)

Paragraph 1

The foreign magistrate will not exercise jurisdiction in Brazilian territory.

Paragraph 2

The activities developed under the program constitute voluntary service, under the terms of Law 9.608/1998, and do not create employment relationships, nor social security or similar labor obligations.

Paragraph 3

All personal, accommodation, travel, and food expenses shall be afforded by the magistrates themselves or by their court of origin.

CHAPTER II

OBJECTIVES

Article 3

The International Program "Global Vision of the Judiciary" has the following objectives:

Iproviding mutual knowledge of court activities, with a focus on sharing good practices and innovative solutions in administrative and judicial areas;
IIsharing knowledge regarding the legal reality of other countries;
IIIdeveloping lines of cooperation in judicial activity and management;
IVestablishing and strengthening networks and partnerships with organizations and institutions of the global justice system;
Vgiving visibility to successful practices that contribute to the efficiency of the Brazilian Judiciary; and
VIproviding the exchange of experiences and information between the bodies of the Brazilian and international Justice Systems, as well as promoting the improvement, modernization, and efficiency of the Judiciary.

Sole paragraph.

The achievement of the objectives indicated in this article will observe the management guidelines established by the host organ, which correspond to the court or body of the Judiciary in which the activities will be carried out.

CHAPTER III

APPLICATIONS

Article 4

In order to apply for the International Program "Global Vision of Judiciary", the foreign magistrate shall register, through an electronic form provided by the National Council of Justice, following the instructions published in Portuguese and in at least one foreign language, preferably English.

Article 5

It will be required that the foreign magistrate presents the following documents:

Ia copy of the mandatory document for entry into the country, accompanied by the respective original;
IIcurriculum vitae, in Portuguese, with photo and description of the area(s) of interest at the host organ;
IIIdocument that proves the status of magistrate for at least 3 (three) years or, even, that it is a retired magistrate for less than 3 (three) years;
IVa reference letter from the court of origin;
Vproof of payment of mandatory health insurance for the entire program period;
VIthe signature of a Term of Commitment with the host organ, under the terms of the Annex to this Resolution;
VIIminimum knowledge of the Portuguese language, which can be affirmed through self-declaration and demonstrated in a possible interview; and
VIIIcertificate or related document attesting the inexistence of criminal convictions as well as attesting the inexistence of punishment in the disciplinary sphere in the last 3 (three) years.

Article 6

The magistrate must indicate, in the application form, the body of the Judiciary in which they intend to carry out the program.

Paragraph 1

The CNJ will contact the appointed court to verify the interest in participating in the program and receiving the qualified magistrate(s).

Paragraph 2

After formal acceptance by the Brazilian host body, the candidate must present proof that has received authorization to participate in the program by the Judiciary of origin.

Article 7

The application formore than one body of the Brazilian Judiciary is allowed, provided that registrations are made in separate and independent forms.

Sole paragraph.

If more than one court accepts the application, the magistrate may choose to have experience in more than one organ, but the program period in each one can not last less than two months nor occur simultaneously, and all the courts and bodies involved must be aware of the situation and accept it.

Article 8

The application confirmation will be sent to the email address indicated on the electronic form.

Article 9

By carrying out the application, the candidate will accept all the rules of this Resolution.

Article 10

The failure to comply with the requirements established in this Resolution will result in application refusal or in the program immediate interruption.

CHAPTER IV

SUPERVISION

Article 11

The activities of the foreign magistrate will be monitored by the host organ's international affairs unit, or related unit, with the support of the personnel management unit.

Sole paragraph.

The Chair of the Brazilian host body shall designate a supervising magistrate, who will be responsible for:

Ireceiving the magistrate and advising him on aspects of conduct and rules of the organ; and
IIorganizing activities aimed at the magistrate's interaction with the Brazilian Judiciary, such as watching hearings and trial sessions, explanation on the operation of national justice, following the work routine of first and second instance judges, among other activities.
Art. 12.
The journey of the magistrates participating in the program will follow the rules of the Brazilian host organ. Sole paragraph. Absences and delays may be compensated at the supervisor's discretion.

CHAPTER V

RIGHTS

Art. 13.
The participants of the International Program "Global Vision of the Judiciary" have the following rights:
Iindicating units of interest within the host organ;
IIreceiving an identification document, of mandatory use, to access the host organ;
IIIreceiving guidance for assigned activities and being accompanied by a supervisor, who will verify their frequency; and
IVobtaining, at the end of the program, a certificate of participation issued by the Presidency of the Brazilian host organ, subject to the requirements set forth in items I and II of the article 14.

CHAPTER

VI DUTIES

Art. 14.
The participants of the International Program "Global Vision of the Judiciary" have the following duties:
Iobserving the rules of the Brazilian host organ;
IIcomplying with at least 75% (seventy-five percent) of the program schedule as well as carrying out the activities assigned;
IIIin case of withdrawal, the participant must notify immediately the Brazilian host working unit and the supervisor;
IVlooking after the property of the host body; and
Vreturning the identification document by the end of the program.

Paragraph 1

The foreign magistrate must present a report on their activities after the completion of the program to the host's international affairs unit or similar unit.

Paragraph 2

Any academic-scientific production resulting from the program must explicitly mention the International Program “Global Vision of the Judiciary”.

Paragraph 3

The duties and prohibitions provided for in the Complementary Law 35/1979 and in the Law 8112/1990 apply, as possibly, to the foreign magistrates.

CHAPTER VII

DISMISSAL

Art. 15.
The termination of the participation in the program will occur:
Iat the end of the program's validity period;
IIby interest and convenience of the host body or the court of origin;
IIIat the request of the foreign magistrate;
IVby abandonment, characterized by injustified absence for two consecutive days or three interspersed days, during the program period;
Vfor non-compliance, by the magistrate, with any clause of the Term of Commitment; and
VIfor conduct incompatible with that required by the host body.

Sole paragraph.

The host body will communicate the end of the participation in the program to the court of origin.

CHAPTER VIII

FINAL PROVISIONS

Article 16

Without detriment to the rules provided for in this Resolution, the Presidency of the CNJ may resolve doubts and fill gaps about its application and is authorized to edit ordinances and notices establishing new terms, conditions, and requirements for the participation in the International Program "Global Vision of the Judiciary", which will be available in Portuguese and in at least one foreign language, preferably English.

Article 17

This Resolution comes into force on the date of its publication.
